But, everyone was not able to fully believe this announcement by SM Entertainment. Professor Lee from Korea Art University stated, “If SM do not wish to have what they have just said to turned into nothing, then they should assure them.” He continued, “Based on what SM have said, they do not wish to fully take on the advice from the impartial committee, but to forcefully come out with a new contract policy, which was questionable (their announcement).” Professor Lee ended, “If SM was really sincere about this, they should work on the new contract based on the advice and not vice versa, and then to get it approved by the representative authorities.”

SM Entertainment, which is caught in an unlawful contract controversy with one of its celebrities,is garnering attention for saying that as long as the law sets or a public organization authenticates the standards for exclusive contracts, the agency would be actively willing to follow such standards.

At the press conference at the 63 Building in Seoul on the 2nd, SM representative Kim Young Min stated, "We would like the political offices related to this industry such as the Ministry of Culture, Sports and Tourism, the Fair Trade Committee, and National Assembly to come together to create new standards for exclusive contracts that will be set by the law or have public organizations authenticate the standards so that these standards are accepted by the law." He also stated, "(If the standards are made in such a way,) SM is actively willing to follow these standards."

Kim continued on by promising that, "If these new standards are accepted by the law, SM will change all of its contracts with its artistes to adhere to the new standards."

Kim also said, "Unless there are contract standards that protect the people involved by law from the time the contract is made until the contract is terminated, and unless such standards are followed, the confusion that is happening currently will only repeat itself."

"If they don't want their words to be empty words, they must secure their sincerity... Follow the recommendations from the Fair Trade Committee first."

But organizations and the public are split over what SM has said. Professor Lee Dong Yeon of the Korean National University of Arts stated, "For SM's declaration to not become empty words, they must prove their sincerity." Professor Lee also stated, "If we go by SM's theory, the current recommendations set by the Fair Trade Committee can be ignored as they do not have legal forced upon others, and SM would follow the news standards if they are legally forced upon the agency. This statement makes one suspicious of the agency's sincerity." Professor Lee also said, "If SM really has the thought of doing what they said they would, then they should adhere to the recommendations of the Fair Trade Committee first and then follow any new standards that are set by the law."

SM Entertainment's President Kim Young Min stated at the press conference held on the 2nd that, "SM has changed clauses regarding compensation and contract period three times in 2002, 2007 and 2008 with the corrective actions and recommendations of the Fair Trade Committee," and "It is absurd to say that such a contract that has been fixed numerous times is called a 'human rights violating,' 'slave contract' and 'antisocial contract'."

However there is retaliation to his statement that says, "If a contract that has been changed three times is in such a state, one can surmise just how bad the original contract was."

After the press conference, one fan said, "Although the root cause of this dispute is the unlawful contract and unfair treatment of the group, SM keeps attempting to draw people's attention away from the root cause," and "I want to ask them if they themselves think that the current contract is really fair and just."

Representative Kim Myung Shin of the Culture Yeon University stated, "There is a need to work on respecting the rights of celebrities as well as an effort by the agency to change," and "The agency itself must work to move our entertainment industry away from the perpendicular relationship it is in."

Representative Kim also said, "A large agency such as SM has the responsibility to set an example as it greatly contributes to mass culture in Korea," and "I hope they show us a mature side that sincerely thinks over this situation and accepts their responsibility to further the development of the Koran entertainment industry."

She also said, "I hope this dispute does not stop as an argument between a large agency and its celebrity, but moves on to be a stepping stone towards a better management system that protects the rights of celebrities, creates fair contracts and has transparent income division."

There are voices that say that in order for these wants to become reality, both the agency and the celebrity must come to a compromise that suits both sides.

Professor Lee stated, "In the view of the agency, it must stop seeing its celebrities as mere tools or products and must engage in a parallel and equal relationship. The celebrity must move away from thinking of personal profit and must think about improving the cultural content of the nation."

The Singer, Son Dambi (26), passed the entrance exam to study
at the Kyunghee University's music department starting in 2010.
Her production office clarified it on November 5th, 2009.

The office quoted, "She took an entrance examination and she passed.",
and added, "She put off studies for her entertainment activities,
but she always wanted to study at the university.
She will manage to maintain both her activities and the studies."

Nowadays, the critiquing of dramas takes its basis from ratings.
When the rating are high, a drama is seen as successful and good, while low ratings make a drama, as well as the actors, a failure. This is why the deciding factor of most of the media's critiques of a successful actor and a failed actor depend on whether that actor was in a drama with high or low ratings.

U-Know Yunho of MBC's 'Heading to the Ground', which ended on the 4th on a gloomy note with 16 episodes, received such appraisal as well. But U-Know Yunho was different. U-Know Yunho, who temporarily left his title as leader of idol group TVXQ that swept all of Asia of its feet to try his hand at acting, grew as an excellent actor despite the fact that his drama received low ratings. Instead of drawing the limit from failure, he worked harder to improve his acting skills.

U-Know Yunho was rediscovered through 'Heading to the Ground'. During the drama, he showed the viewers who actor Jung Yunho, not singer TVXQ's U-Know Yunho, was. According to those involved with the drama, U-Know Yunho matured and grew rapidly as an actor in 'Heading to the Ground' from episode 1 to 16. The insufficiency of episodes 1 and 2 were filled by episode 3 and 4 and he began to show a more mature acting through episodes 5 and 6 and began drawing the viewers' attention.

The decision to partake in 'Heading to the Gorund' in itself was a great challenge to Jung Yunho. In the case of most rookie actors, they choose characters that will continue and better their popularity and image such as flower boys, business tycoons, charismatic guys, bad boys, or geniuses. But U-Know Yunho broke out of his image as an idol on stage and showed a quite different side of himself. He wanted to be reborn as an actor. To overcome the handicap of it being an idol star's first acting attempt, he went head on with situations in the drama without the use of a stunt double and won.

His character Cha Bong Goon was more memorable because he was not a cool character, but one who seemed to be lacking in some way. He showed everything from bizarre facial expressions to comical dancing. Although the charisma of TVXQ he had built up since his debut had disappeared, he was able to show everyone the birth of Actor Jung Yunho.

TVXQ's U-Know Yunho, who now has five years of a singing career under his belt, has evolved into a talented singer but has just begun to mature as Actor Jung Yunho. His youth and passion for challenges are beautiful, there are hopes to see what else Actor Jung Yunho has to offer in dramas and in movies.

TVXQ's YoungWoong Jaejoong will be watching a movie with his fans.

'Heaven's Postman', starring YoungWoong Jaejoong and Han Hyo Joo, will be holding it's preview screening for fans on November 9th, 7:30 pm at the CGV WangShip-li.

'Heaven's Postman' is the story of a love between Jaejun (YoungWoong Jaejoong), a special guy who send letters written by those who cannot forget their deceased loved ones to Heaven, and Hana (Han Hyo Joo), a woman who cannot forget her deceased lover.
This production has been garnering attention as it marks YoungWoong Jaejoong's first attempt at acting.

The planned preview screening give people the chance to watch the movie before it is officially released and is specially catered towards fans who have waited to watch the movie since YoungWoong Jaejoong was cast in it. YoungWoong Jaejoong plans on showing his appreciation for his fans on this day by appearing at the preview. The official release date of the movie is November 11th.

In an interview SHINee were asked about being labelled as “Puppets of SME”. They responded with a resounding statement:

That’s prejudice against SM Entertainment. SME gives us a lot of say and freedom. Even during our album preparations, they ask us for our opinions. The albums are released under our name and thus it is our music.
The public appear to have a predjudice against idols. Just like how the same song, Chocolate Love, can be presented differently by two different groups, SNSD and f(x), we have our own opinion and own colour. The company supports us, no doubt. However, being forced to do something does not and should not happen.
SME helped us a lot in the beginning as we didn’t really know what to do. But as we gained more experience, we start to express our opinions. The company reflects our opinions on many things such as the lyrics, pairing of members and our style. Without such supportive environment, we won’t be able to sing our songs like we sing them now.
They also expressed their pride in their company:

SME listens to the artists’ opinions and everyone is close, unlike other entertainment companies. Everyone respects each other and supports each other, just like you can see in Dream Concert or SM Concert. [NEWS] 091104 TVXQ: Slave contract or ingratitude

"It is a case of national fraud which has been concealed by words such as 'human rights' and 'slave contract'," SM Entertainment CEO Kim Young-min calmly read from a press release stating the agency's position regarding three members of TVXQ applying for provisional disposition of their contract with SM. But the remark, made during a press conference Monday morning, were beyond expectations. Kim went on to argue that the legal dispute came to light because of a cosmetics business which Micky, Hero and Xiah took on without discussion with SM. "They violated the contract first for their own gains and took legal action to cover it up," he said, adding that the court "will be protecting their individual egoism and ingratitude" if it rules in favor of the three singers.

But even more surprising was TVXQ members' U-Know and Max's position on the issue, revealed through a press release during the press conference. The statements, signed by the two, read: "We cannot believe that TVXQ may collapse because of a cosmetics business" and their fathers said the other three members were using the issue as "an excuse to cover up the fundamental reason (cosmetics business)". The statement by the two members are meaningful in that they could turn around the focus of entire case. Below are the main points at issue.

 

I. Background on legal dispute

 
Micky, Hero and Xiah applied for provisional disposition of their contract with SM in late-July, stating it was actually a 'slave contract' for the following reasons: ▲ TVXQ had signed a ten-year contract with SM which was renewed to a total 13 years ▲ TVXQ would not receive any profit from album sales unless over 500,000 copies were sold (altered after February 2009) ▲ If any member of TVXQ cancelled their contract with SM, that individual would have to compensate by paying twice the amount of the profit they would make in the future. The three declared the contract was not fair and wanted it corrected.

Meanwhile, SM argued during their press conference this week that the three members' business with cosmetics brand CreBeau was at the root of the dispute. SM said through a press release that the singers took legal action after starting to clash with the agency over their cosmetics business. According to SM, the three members requested a court to nullify their exclusive contract with the agency after the following incidents: ▲ The three signed a contract with CreBeau which would entitle them to five percent of the company's sales as royalty and held a promotional event as TVXQ without consent of their agency and ▲ The three declined to shoot a commercial for a major cosmetics brand because of their own business. SM's logic is that the three did not take legal action because of the contract they call unfair but to fulfill their bigger desires. CreBeau filed a lawsuit against SM for libel soon after, stating that "each members invested only a certain amount of money in the business, their intellectual property such as their names or photographs were never used, and they do not have a say in management of the business at all."

 

II. Legitimacy of their contract

 
Last week, the Seoul Central District Court made an interim court ruling, saying SM cannot sign contracts in opposition of the opinions of the individual's of TVXQ and will not interfere with their activities as a celebrity until a final verdict is made -- acknowledging there could be problems to the contract, based on legal standards. The three have also declared they have not received any of their share of profits since February this year.

But SM stated it had accepted most of the members requests to have their share in profits increased. According to SM, ▲ TVXQ voluntarily made the decision to sign a 13-year contract with SM who had guaranteed investment and support in their vision ▲ SM corrected the terms regarding compensation over cancellation of the contract in 2002, 2007 and 2008 upon recommendation by the Fair Trade Commission and ▲ SM agreed to greatly increase TVXQ's share of profits starting February 2009 and applied the term retroactively to the profits they made starting late 2008.

SM also stated that a wrong decision by the court could "bring the downfall of the industry's system which made 'hallyu' possible through long-term investment and raising stars". They went onto argue that, "If a contract, originally signed between two parties upon their consent and free will, is not valid after the success (of a singer or actor), this will bring confusion to the entire entertainment industry...... Many similar cases in the future will arise where they will try to come up with some sort of reason or excuse not to stick to their contract." SM emphasized on the special nature of the industry which invests large amounts of money to create a single idol group and that the contract was signed upon mutual consent.

 III. Future of lawsuit

``The court's recent decision has temporarily granted the three members the rights to do their individual activities, but they can only work as TVXQ under the agency,'' SM said during the press conference. They also declared that they will ask the three for financial compensation for the losses and damage incurred upon the group and the agency with the ongoing legal action. And SM gave the three members a 10-day deadline, till November 12, to decide on whether they will be part of the team to resume their activities in Korea next spring.

But it is uncertain how much of an influence SM's argument will have on Micky, Hero and Xiah. Even if SM's remarks are true, the ongoing legal dispute is over provisional disposition of the contract itself and the court has already made an interim ruling based on whether their contract with SM is unfair.

IV. Will TVXQ continue to exist?

The biggest incident during the press conference was that U-Know, Max and their fathers revealed their stance on the issue -- showing their support for SM which widened their gap with the other three members. Till then, both parties had refrained from making emotional reactions toward each other because they both wanted their group TVXQ to last. But now, the dispute may turn into an expose. If the dispute up till now was about the contract between SM and the three members, there is a chance that they now might battle over whether the group will continue to exist. Of course, both sides have said they wish to remain in TVXQ but it seems impossible that they will be able to do without scarring each other. Will they be able to continue to exist? The case is now set at an important crossroad.

[NEWS] TVXQ members threatened with expulsion

The ongoing legal feud between three of the five members of the popular boy band TVXQ and their management agency, S.M. Entertainment, has now entered a critical phase.

In a press conference held Monday, S.M. Entertainment issued an ultimatum to the three band members - Xiah Jun-su, Micky Yoo-chun and Hero Jae-joong - saying they must decide whether to return to their original contract by Nov. 12 or quit the band altogether. The management agency added that they would appeal a recent interim court ruling made in favor of the three band members for a provisional disposition, which temporarily terminates the exclusive contract between the group and the agency for the duration of the dispute.

In the dispute that started this summer, the three band members claimed their contract with the agency is akin to a lifelong agreement and is therefore unfair.

The other two band members - Max Chang-min and U-Know Yun-ho - spoke out against their bandmates for the first time through a written statement released by the agency at the Monday press conference.

“We think that TVXQ cannot exist anywhere but in S.M. [News] 091105 Youngwoong Jaejoong will Attend Heaven’s Postman Press Conference

TVXQ Youngwoong (real name Jaejoong) will finally make his first public appearance after the raising of exclusive contract issue conflicts.

On November 9th 4:30 pm at CGV Seoul, Youngwoong will attend the press conference for his debut movie “Heaven’s Postman” (director Lee Hyeong-min).

“Heaven’s Postman” which is starring Youngwoong Jaejoong and Han Hyo-joo is a Korea-Japan joint project which has been gathering much attention and become a hot issue. Through this premiere press conference, the experience of Jaejoong with his debut acting challenge in “Heaven’s Postman” will be reported.

One of the official strictly gave advance noticement, “The press conference is about the movie, and there’s no association with the legal dispute Youngwoong is involved. So I hope for the understanding not to ask any questions related to the dispute.”

[NEWS] 091105 Yunho’s HTTG Shooting Completed

Tohoshinki’s YUNHO (Jung Yunho) has finished the last shooting for the Wed & Thurs drama “Heading To The Ground” (MBC).

A related person said on Nov 3 “The last shooting was a soccer scene. It was piercingly cold so that it was much difficult than previously shootings. The staffs wore thick jackets, but all the actors playing soccer (including Jung Yunho) only wore soccer wear (short pants), so it should have been difficult.”

This day, Jung Yunho shot a scene being accidentally toppled by another player, committing many fouls. But he did not forget to smile till the end, and have done his best. All were very impressed. The other actors was influenced by Yunho, and pumped up thinking “Let’s take care of ourselves not to be injured, and hang on till the end”.

[NEWS] Lawsuit may lead to TVXQ split

The possibility of Korea's top idol group TVXQ disbanding is increasing, after their agency sent an apparent ultimatum to three of the five-member boy band to return to the agency.

Speaking at a press conference on Monday, SM Entertainment chief Kim Young-min accused the three members -- Xiah, Hero, and Micky -- of having sued against the company out of greed to make more money.

Kim was speaking about the ongoing legal battle between the three members and the company. The three band members claim the contract signed between TVXQ and the management agency is unfair.

Last month, a lower court sided with the three and ruled that parts of the contract should be invalidated, paving the way for them to resume individual music and advertisement careers.

The agency vowed to bring the case to a higher court, saying the three must follow the contract as long as they continue to be part of TVXQ, and should get paid according to the current contract.

The other two members -- U-know and Max -- rendered their support for the management agency's claim, expressing hope that the other three would return quickly.

In their statement, the two stressed that all members have worked under the same contract with SM Entertainment for the past five years.

"We believe that TVXQ would not have been in existence without SM Entertainment, which created the group. We are also not willing to resume our career as TVXQ without our current agency," the statement said.

In a related movement, SM Entertainment chief Kim made it clear that although the court granted freedom to the three members to pursue individual activities, they are allowed to work as TVXQ only under SM.

The company demanded that the three members reply to its request to return to the agency by Nov. 12.

But it is widely viewed that the three are unlikely to continue to work with the management agency due to deep distrust between the two sides.
