[INFO] Message from Bigeast fans

Message from Bigeast fans:

Dear Cassiopeia Members,

This is Kocha from Bigeast, Japan.

This may not be the appropriate place to post this news,
but we do not know exactly where to, since most of us cannot
write Korean.

First of all, we would like to thank you all for always protecting TVXQ and keeping the faith in them.

Because of the differeces in organization and in culture, we cannot do as much as you do in SK and the rest of Asia.

However, now that TVXQ are in Japan, we would like to do our
best to avoid their disbanding.

We know from the news TVXQ are very close to disband.
And we've learned fan's power is very needed.

We are working on this movement, called "Send A Thank You Postcard to AVEX".

It is to let Mr. Matsuura know our appreciation for his support for the five, and also to beg him to guarantee their activity in both S.Korea and in Japan (and the rest of Asia).

We believe there is no Tohoshinki without Dong Bang Shinki.
TVXQ is the precious star that was born in S.Korea.
It is unbearable to see them not able to sing in their own country.

The thank-you post cards are supposed to be arrived at AVEX on
November 30th.

It is important that all the mail arrive on the same date so that Japanese media will pick up the news.

But this may not enough, because Japanese media this year tend to focus on Arashi's 10th year anniversary and their first time attending Kohaku.

We would like to make sure that this "send a thank-you post card to AVEX" to be broadcasted and told through Korean media, so that
SM will hear it clear.

So, we need to ask all the bilingual(English/Korean/Chinese etc.) writers a help.
Because we believe this may be our last chance to keep the five together.

PLEASE!! spread this news here in DBSK Knights, DNBN, Korean TV Stations, Korean newspaper, Korean magazines, and any other media
possible.

We don't want to lose our last chance!!

Make sure to let them know that even the QUIET Japanese fans are raising their voice!!

However, we are not hoping for a battle.

If there is 1% of possibility for them to avoid disbanding,
we would like to bet on it.

Again, all the mail will be ARRIVED at AVEX on November 30th.

[TRANS] 091124 TVXQ-Super Junior Fans Are Dead Upset...

Concert Cancellation turns into a Mass Dispute

632 fans of SM Entertainment singers such as TVXQ, Super Junior, Girls' Generation and SHINee have filed for fiscal and emotional compensation for the cancellation of the 'SM TOWN LIVE'09' concert that was scheduled on August 16th against SM Entertainment and Dream Maker.

The Korea Consumer Agency's Court Committee of Consumer Disputes announced on the 24th that "We are planning to allow all consumers with the same complaints submit these complaints at the same time from November 25th till December 9th."

Those wishing to apply to this method must go to the Korea Consumer Agency homepage (ww.kca.go.kr)'s Consultation Forum - Group Dispute Trial Participation/Inquiry.

Those applying for this inquiry must have bought tickets for the 'SM TOWN LIVE '09' concert from G Market or Dream Maker, and in the case that the applicant is a minor, a guardian can apply for him or her.

This happening will determine whether or not concert planners should pay compensation as well as a full refund when a concert is pushed back to an undetermined date or canceled.

According to the Korea Consumer Agency's rules regarding concerts, the concert planner must pay a full refund as well as 10% additional compensation if a concert is canceled.

On the other hand, TVXQ fans, who have been acting as the forerunners to this consumer movement, visited the Korea Consumer Agency in Seocho, Seoul in person to submit a complaint about the cancellation of the 'SM TOWN LIVE '09' concert and to request compensation.

The submitted this request under the name 'Victims of the SM Concert' and stated, "This is not a mere problem between a fan and an entertainment agency, but one between the consumer and the supplier," and "We are not merely looking to gain monetary compensation from this, we would like to keep our rights as consumers so that we do not have to sit idly by while suppliers continue to tyrannically attempt to control us."

[TRANS] 091124 SM "We Never Sold TVXQ Tickets Without Permission"

SM has released an official statement regarding the civil appeal TVXQ fans submitted to the Ministry of Culture, Sports and Tourism that pertains to the group's China concert.

On the 24th, SM stated to Money Today Starnews that, "We had originally planned twelve concerts for TVXQ's third Asia concert tour with Korean Concert Agency Dream Maker in June of 2008," and "According to the contract, all concert procedures and permission applications, as well as ticket sales are being covered by Dream Maker and a domestic concert planning agency."

They strongly stated that, "Therefore, it is incorrect to say that SM sold TVXQ's Shenzhen concert tickets in China without the permission of the Chinese government."

SM also added, "We conversed with concert planning agency Dream Maker, who was in charge of the Shenzhen concert that was to be on the 21st as well as the entire Asia tour. Dream Maker stated that there were no problems with ticket sales or permission grants for the Shenzhen concert."

SM stated that Dream Maker said, "The Chinese concert planning agency we worked with was the 'Nanjing Asia Pacific Correspondence of Culture Exchange Corporation' and they were informed by the People's Republic of China's Ministry of Culture that 'Permission is granted for TVXQ's Guangdong (Shenzhen) concert' on the 21st of October. The Chinese agency also received the 'Ratification by the Ministry of Culture of Korean TVXQ's Concert in Guangdong (Shenzhen) [2009] Number 2146." Dream Maker states that it began selling tickets as soon as permission was granted on the 21st.

SM said, "The 'TVXQ Guangdong Concert Permission Related Ratification' that was released on October 28th was related to the documents and visas foreign artistes needed to perform in China, and had nothing to do with ticket sales."

They continued by saying "We are having to pay compensation to the Chinese concert planning agency as the Shenzhen concert was canceled," and "To say that we would sell concert tickets, then cancel the concert on purpose is just a spiteful statement; we would like it if people stopped saying false accusations that are far from the truth."

[TRANS] 091123 'They Sold Tickets Without Permission' TVXQ Fans Submit A Civil Appeal To The Government

The China, Guangdong Culture Board's Shenzhen concert Approval According to the statement released on the Guandong Culture Board's webpage, TVXQ's Shenzhen concert officially received permission on October 28th. However, SM began selling tickets for the concert in late September.


TVXQ fans have submitted a civil appeal against SM Entertainment to the government stating that the agency began selling tickets of the Shenzhen concert, originally scheduled for the 21st, before they received permission from the Chinese government.

TVXQ fan site 'DNBN' submitted a petition under the name 'SM Entertainment's Disregard for the Chinese Administrative Procedures may obstruct Culture Exchanges between Korea and China' to the Ministry of Culture, Sports and Tourism on the 16th.

They pointed out that, "On the homepage of the Guangdong Culture Board, it clearly states that SM received permission for TVXQ's Shenzhen concert on October 28th," and "Ticket sales began in late September, therefore, SM was selling tickets without permission from the Chinese government."

They especially stated that, "The fact that China has administrative procedures for such an event implies that SM is publicly disregarding another country's administrative procedures," and "Such ticket sales could not only hurt the image of the Korean Entertainment industry, but the image of the country as well. What SM did resembling gambling in which the future performances of Korean singers in China are on the line."

They also added, "Till now, SM has been getting permission for Chinese concerts at least 4~6 months before the concert date for their singers and then proceeded to sell tickets, but this concert seems to be the only one that SM rushed to get."

In the appeal, these fans asked that the official dates of permission application and permission for the Shenzhen concert as well as the ticket sales period be checked thoroughly. They also asked for action to be taken against the act of selling tickets before permission was given by the Chinese government.

On the other hand, a representative of the Ministry of Culture, Sports and Tourism stated, "Although there is no way for this ministry to personally go into agencies and watch over what they do as entertainment agencies are free enterprise businesses, we can call a representative of SM forth to clarify and set regulations so that such an event will not occur again."

This representative also said, "In China, permission must be given before advertising or ticket sales are allowed, so we do not know why SM acted in such a way," and "If the Chinese government feels that there was a problem in the administrative steps of the procedure, the future culture exchange between the two countries may be endangered so we would like SM to be more careful from now on."

The 632 fans of TVXQ, Super Junior, SNSD, and SHINee are in process of filing application of collective disputes against SM Entertainment-Dream Maker for the cancellation of the planned August 16th SM TOWN LIVE ‘09, demanding compensation for property and mental damages.

Korea Consumer Agency (KCA)’s Consumer Dispute Resolution Committee on last 23rd was asked by applicants related to the case of unilaterally cancellation of “SM TOWN LIVE ‘09″ as they demanded property and mental compensation which follows in collective dispute resolution procedure process on the 24th.

Dispute Resolution Committee initiated this collective dispute resolution procedures, and the committee will receive registration from other victims of this issue to have the same batch remedies from November 25th until December 9th.

Consumers that are willing to apply can log in to Korea Consumer Agency website (www.kca.go.kr) – consultation area (상담 마당) – dispute resolution group (집단분쟁조정), ones need to apply in order to join the collective resolution remedies.

Applicants must be ones who purchased Dream Maker Entercom’s “SM TOWN LIVE ‘09″ through domain auction and in case the applicant is a minor (a person who is under the age), the minor’s parents must apply for the participation as legal representative on the minor’s behalf.

The presentation of this case is about the past contractor’s act of concert postponed or canceled unilaterally therefore asking for liability to refund for any damages had been occurred.

[INFO] Mezamashi TV News: Kohaku selected artist for 2009: TVXQ in, Bigbang out

TVXQ In: Bigbang Out:

Around 03:02, they announce the name of TVXQ (東方神起) as a chosen performer of Kohaku 2009,
but interestingly that Mezamashi TV station had already placed a flower on TVXQ's name.
So, Mezamashi TV program must have known TVXQ's appearance at kohaku 2009.^^

Bigbang had mentioned many times in their interviews in Japan that
their wish in Japan is to perform at Kohaku this year.
However, they did not make it this year.
(In the Mezamashi TV we can spot Bigbang's name on the list.
And they had a special "watch" mark in front of their name.)

Everyone knows that Bigbang is a talented performer.
It is just being selected to perform at Kohaku is something very special in Japan.
Like Jero who made it to perform at Kohaku for the first time with TVXQ last year
had openly shared his dream in his life was to perform at Kohaku and he cried at Kohaku.

TVXQ's YoungWoong Jaejoong, Micky Yoochun and Xiah Junsu, who are locked in an exclusive contract lawsuit with their agency, attended the '2009 Mnet Asian Music Awards' at the Seoul, Jamshil Indoor Gymnasium and received the Best Asia Star Award.

[NEWS] 091121 3 TVXQ Members: “It Would Have Been Better If 5 Members Could Attend.”

Asia Pasific Music Awards 2009 Mnet Asian Music Awards (MAMA) was held at the Jamshil Indoor Gymnasium on November 21st, the six hour live from 17:00 to 23:00 will broadcast in 10 major Asian countries Japan, China, Thailand, Taiwan, Hong Kong, Philippines, Macau, Malaysia, Indonesia and Singapore simultaneously.

Three members of TVXQ namely Micky Yoochun, Xiah Junsu, and YoungWoong Jaejoong, who are in legal dispute with their agency SM Entertainment, regardless their agency’s decision to boycott the event announced their attendance at the awards ceremony and many are curious about the future of TVXQ.

On the 21st, the three members said through Mnet, “All five members will participate in various international awards at the end of the year as TVXQ,” and “So far we’ve been focusing a lot on overseas activities, therefore we feel sorry for all Korea fans who keep waiting for us.”

The three members also said, “Through this music festival, we want to greet and say thank you to our fans,” and “It would have been better if all five members could attend.”

“We believe that as a festival that brings Asia together through music, the creation of ‘2009 MAMA’ is really important.” and “As Korea artists that has Asia-based activities, we feel grateful to have such an awards ceremony was created in Korea.”

The three TVXQ members also revealed their interesting friendship through the winning speech. The deep friendship between the members of TVXQ was shown as Junsu stated, “This award is not for one single member, but because all 5 members have put so much effort we are able to receive it.” and Jaejoong continued, “I’m hoping that many international and local fans are watching this right now also our two friends who don’t come tonight, as I want to say that I love you.” he referred to the absence of U-Know Yunho and Choikang Changmin.

In addition, related to their current conflict, Micky Yoochun vaguely express his feeling through this chance, “I think this is the first time I’ve wanted to sing so badly. I’m able to meet great members, that’s how finally we get here. We will work harder to expand beyond Asia. We hope for even more support than now.”

Mnet stated, “As TVXQ is the representative of Asia stars, we officially invited all five members to attend MAMA awards,” and “As they have decided to attend for good purposes, we hope that people do not see their decision in a bad view or have any misunderstandings.”

TVXQ fans who were at event location sang a TVXQ song together as commercials were playing at the end of “Act 1″ to show their love for TVXQ. They also waved their red balloons and shouted “TVXQ” to show their belief that TVXQ would remains.

"The Shenzhen Concert Note of Confirmation, we never signed it ourselves."

Three members of group TVXQ stated that an unauthorized use of their signatures was used for the documents relevant to the Shenzhen concert. Xiah Junsu, YoungWoong Jaejoong, and Micky Yoochun's representative stated on the 19th that, "We realized only recently that the signatures of the three members of TVXQ were being used without authorization. The signatures on the Shenzhen concert note of confirmation were not signed by the three members themselves, but somebody else signed the paper instead."

The three members side found out about the unauthorized use of their signatures on the note of confirmation after their Korean and Chinese fans questioned the validity of the signatures. The note of confirmation in question was the document that recognized the singer's willingness to attend the concert in China. This document was then shown at the location of ticket sales in order to prove to ticket buyers that the singer would indeed be attending the concert. Sejong Law Firm's Lawyer Lim Sang Hyuk of the three TVXQ members stated, "Setting aside the validity of the Shenzhen concert contract, this act was an action that brought misunderstanding to the fans. We are planning to take counteractions against this action officially."

Sejong also released a hand written document of Mr. A who says he signed the note of confirmation instead. He also showed the actual signatures of Xiah Junsu, YoungWoong Jaejoong and Micky Yoochun to show that there were clear differences in the signatures. according to the hand written document, Mr. A "Signed the Shenzhen Concert note of confirmation instead of TVXQ in March." Mr. A's claims are to be investigated.

Lawyer Lim stated, "On the 19th, we requested for a judgment by an expert on the signatures on this note of confirmation and the members' original signatures. Even just by seeing it, you can tell that there is quite a big difference."

He also said, "When this lawsuit was initiated, the three members promised to perform all preassigned activities. However, the Shenzhen concert was not one of them. The members found out about the Shenzhen concert during the procedures of the lawsuit." He also said, "Even the fans new that there was a problem with the signatures on the note of confirmation. Therefore, we asked SM to show us the details of the Shenzhen concert contract but SM did not comply."

One representative of Korean music industry, "In the case that the singer in an agency is busy, there are times when a representative signs the papers instead after telling the singer of the concert or the schedule." This representative also stated, "When the relationship between the agency and the singer is good, there are no problems . In such a case, I believe that it has become a problem due to the deteriorating relationship between SM and the three members of TVXQ."

The 3 people under SM label who are currently in dispute with their label from 5 members-group TVXQ namely Youngwoong Jaejoong, Micky Yoochun, and Xiah Junsu will make their first public appearance in the upcoming year-end award event.

According Mnet representative on the 19th, the three members decided to finally attend the first-held year-end music award by music cable channel Mnet, “Mnet Asian Music Awards” (MAMA) which will be opened on November 21st in Jamsil Indoor Gymnasium, Seoul.


The official to Star News, “Mnet representative recently made public relation with the three TVXQ members and through this process, the attendance of the 3 members is decided,” he said. “Youngwoong JaeJoong, Xiah Junsu, and Micky Yoochun will attend MAMA and be able to greet the viewers and fans after a long time.”


He added, “The 3 TVXQ members to sing on stage or only come for a simple greeting, we don’t know as it’s not yet further decided.”


Despite the 3 TVXQ members attendance, the chance for whole 5 members of TVXQ to attend MAMA seems to be impossible for now.


The other members, TVXQ U-Know Yunho and Choikang Changmin are still attached with SM Entertainment (SM) and maintain good relation with the label, while just a while ago SM already declared boycott over MAMA’s nominees. Therefore, regardless the attendance choice of the other 3 members, the possibility of Yunho and Changmin not to come along with Jaejoong, Yoochun, and Junsu is very high.

[NEWS] JaeChunSu accused of fraud in China

Jaejoong, Micky Yoochun and Junsu, the three members of TVXQ / DBSK / Tohoshinki who took legal actions against SM Entertainment, have been sued for fraud in China along with Chinese subsidiary of the controversial cosmetics company CreBeau.



The plaintiff is a firm which is the distributor of CreBeau products in the Shanghai, Jiang Su and Sanxi region. A representative of the plaintiff stated:

"We were told by CreBeau that the three members were the board members of CreBeau, so we naturally believed that they will partake in promotions, which is the reason why we invested in this business. However, the three members did not appear on product announcement in Shanghai last July, resulting in fans complaining to us and returning the products. The overall loss that we suffered amount up to 1 million Yuan ($150,000). Yoochun and Junsu apologized to us regarding the matter but this fraud left us with too much damage, so we sent CreBeau a notice on October 22nd telling them to pay for the damage caused by their misrepresentation. However, we did not receive an answer and CreBeau closed their office in Beijing, so we had no choice but to sue them."

To this claim, CreBeau answered:

"We are analyzing this matter right now but it appears that they are making unreasonable claims. We have warned them about overly promoting the involvement of TVXQ members and it appears that they are suing them because we have stopped our ties with them due to various reasons. They say that we closed our office but in fact it just moved to another district of Beijing. Other distributors are doing fine in China."

On the 16th, it was revealed by Mnet's office that they have invited TVXQ, whose members are in the midst of a legal dispute with their management company, to attend their year-end awards "Mnet Asian Music Award" (hereafter known as MAMA). This year's MAMA will be held on the 21st November, Seoul, Jamsil Gymnasium.

Their office said, "MAMA's aim is to show the rest of Asia Korea's culture" and "the award ceremeony will be aired across the 10 main countries in Asia, like Japan, China, Malaysia, Singapore and Thailand, where TVXQ is the best artist. Thus, Korea's top artist cannot be excluded from the invitation."

On MAMA's end, they have expressed interest in inviting TVXQ to attend their awards. On the 16th, they said that they would get in touch with TVXQ's management to see whether it would be possible for them to attend or not. However, TVXQ's company, SM Entertainment has declared that they would not be attending MAMA, so a lot of attention has been cast on TVXQ to see whether or not they will attend.

An official from the KPOP industry said, "Last month, the courts approved a partial injunction to the 3 members' exclusive contract with the company, and the 3 members are allowed to participate in their own individual activities" and "while we hope that all 5 members can attend together, the possibility of only the 3 members attending is high".

MAMA is holding their award ceremony on the 21st, which was originally the date of TVXQ's concert in China. However, SM Entertainment claimed that, "The 3 members expressed that they did not wish to participate in the concert that was to be held on the 21st, and the remaining performances are uncertain." In contrast, the 3 members' side claimed that "From the beginning, the China concert (Shenzhen) was not in the contract."

A representative from a company for idol groups said, "SM Entertainment and the 3 members have differing opinions, and the dispute is becoming more serious. Disbandment might be inevitable."

[NEWS] 091114 Avex: "No Change In Japan with TVXQ's Activities"

In Korea, the media reports their viewpoint that five members of TVXQ
to perform together in year 2009 will be difficult.
They also report that TVXQ's future activities in Korea in early 2010 to be unclear.
TVXQ's Concert in China which was planned on November 21st, 2009 has been canceled.


However, in Japan, it is decided and reported that,


"TVXQ will release their new song, "BREAK OUT!" in new year 2010."


And also,


"TVXQ's fan meeting performances have been confirmed" as well.


Avex has reported that,


"There is no change in plan with TVXQ's activities in Japan".



T/N: Meaning that all the activities planned in Japan WILL happen.

No change at all in Japan!
All five of them will release the new song, "Break Out!" together,
and five members will perform at the fan club event together next year.
And they will soon fly to Japan together to do their end of the year activities.

[TRANS] 091113 Chinese Fans Response To Cancellation Of Concert

(part 1)

This morning we received news about the cancellation of the Shenzhen concert. Considering the court dispute at the moment, this wasn't a decision not thought of.

We cannot say "everyone please calm down, please don't say anything bad", because that isn't facing the truth. However, we hope no one says anything that would hurt the members of TVXQ, doing something that shows you don't understand the five members. The people we love, they did not do anything wrong. I hope everyone sees and clearly understands this point.


The Shenzhen concert was decided upon by SME and the organizer after the three members proposed the lawsuit. If everything was normal, activities organized for the artist by the company acceptable, but no matter when, it needs to respect the artists wills and thoughts. Artists are not tools, they are human too. SME had secretly accepted the offer of overseas activities without discussing the details with the five members, this action is not respectful to the five members of TVXQ.

At the same time, because of the decision between SME and the Chinese concert organizer, it has led to losses for the fans, and this is not forgivable. Because of SME's own decision that led to economic and psychological losses of Chinese and overseas fans, we should receive a proper explanation and compensation.

Since the start of the lawsuit, SME had pushed all the blame upon the members, using unrelated topics to cover the real problem, making all of TVXQ's fans feel very disappointed and angry. Being Korea's top agency, not respecting group members, ignoring fans reasonable requests, and during the lawsuit which started as a simple issue that could of ended well, but didn't because of the various disruptions and accusations created against the three members. This issue not only led to the five members of TVXQ go under stress and pain, but it also led fans to fall into despair, to the point where the fans split. Actions like these make people 'angry'. [T/N im guessing the meaning of it, it was a saying >_<]

For this times Shenzhen concert, SME again pushes the blame towards the members, making us fans feel very disappointed and angry, we do not hold anymore trust or hope towards SME. It is not the members fault, yet they have them to shoulder the responsibility, letting them face criticisms, this is what the company that brought them up do. This is unacceptable.

We cannot represent everyone, but representing all the fans supportive of TVXQ from Baidu, we cannot forgive SME's continual injuries and stress given to the three members. The cancellation of the Shenzhen concert is all because of SME's contract signed with the organiser, without consulting the members, it has no relation to any of the TVXQ members. SME, please stop bringing out all these rumours, which end up hurting the members and splitting the fans.

On another note, we feel dissatisfied with the Chinese organiser of the Shenzhen concert due to their signed documents lying to the fans. Even if we understand that the project needs to have communication with SME, but to make an irresponsible promise with the fans, they too have an undeniable responsibility.

[NEWS] 091113 SM’s Official Stand, “Dong Bang Shin Ki’s Comeback Next Year – Impossible”

SM Entertainment revealed their stand for their discord with trio Hero JaeJoong, Xiah JunSu and Micky YooChun of group Dong Bang Shin Ki[/b] through reports on 13th november.

SM Entertainment said, “We gave the deadline for the 3 members to give us a reply about Dong Bang Shin Ki’s comeback in Korea next year by 12th November previously during our press conference on 2nd November. But we did not get any response. This has hence make the group’s comeback in Korea next year impossible.”

SM Entertainment also added, “The trio has agreed to carry out the schedule planned on basis of the basic contract between the company and the group before the court during the time when the trial was on going. But after part of the trial judgement came out, the trio said they will not participate or the coming concert performance on 21st November in Chin which is part of their Asian concert tour performances decided as of June 2008, and for subsequent concert performance, they have stated that they may not be participating for them.”

“We will decline the idea for the 3 to promote as Dong Bang Shin Ki. This will have adverse effects on our company’s artistes as well as concert performances scheduled in China.”
